What is the process?
The process typically begins by a party providing a death certificate and completing a form to open an estate in SC Probate Court. An administrative process begins and is relatively uncomplicated if an an executor was named in will or trust was prior to the time of the decedent’s death. The executor is then allowed to follow out the will or trust accordingly; however, if it is not fully clear about how the estate of the decedent should be handled or divided then Probate Court is allowed to proceed in determining the outcome of the estate.

This can pose a major strain to the strongest of families, as a result some judges order mandatory mediation. In some cases, parties elect to voluntarily engage in mediation. Either way, the process of mediation allows the family members the opportunity to work through the daunting task of diving an estate with the goal of preserving family ties after the estate has been handled.

What qualifies someone to be a certified probate court mediator?
A licensed attorney, psychologist, master social worker, independent social worker, professional counselor who has a minimum of three years of experience in his or her profession and has taken a 40 hour mediation training course approved by the SC Bar Association may be certified as a probate court mediator. Felicia Reid LPC completed this required training, has been certified by the SC Bar since 2014, and has engaged in providing mediation services to assist people arrive to amicable solutions.
